These Terms of Service govern your use of Framepad IO, including the Framepad IO website and desktop application. By using Framepad IO, you agree to these Terms.

If you do not agree with these Terms, please do not use Framepad IO.

2. Scope of Use

Framepad IO is provided free of charge for personal, educational, and professional use. You may use Framepad IO only in compliance with applicable laws and these Terms.

You must not misuse Framepad IO, reverse-engineer its compiled binaries outside the scope of standard interoperability exemptions, or attempt to interfere with its normal operation.

3. Availability & Application Updates

We strive to optimize Framepad IO, but because it is provided free of charge, we do not guarantee uninterrupted availability or continuous maintenance.

We reserve the right to modify, patch, suspend, or discontinue specific features, build pipelines, or the entirety of Framepad IO at any time without prior notice to facilitate product iteration.

4. User Content & Telemetry

Any data configurations, node layouts, or project files you create using Framepad IO remain entirely your intellectual property and are stored locally on your individual device. We do not host, review, or store your project content files on our servers.

To improve software stability and analyze feature utilization, the application may transmit aggregate technical telemetry and interaction data to our processors, subject to your explicit choice in the application's consent settings. For details regarding data handling practices, please refer to our Privacy Policy.

5. Intellectual Property

Framepad IO, along with all associated structural source code, logos, interface designs, and software assets, are protected by copyright, trademark, and other intellectual property laws. These Terms grant you a limited, non-exclusive, revocable license to run the software, but do not transfer any underlying ownership rights or corporate identity marks to you.

6. Disclaimer of Warranties

Framepad IO is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability or fitness for a particular purpose.

You acknowledge that running local desktop applications and interfacing with external hardware (such as MIDI controllers or physical instruments) involves inherent environment risks, and use of Framepad IO is entirely at your own risk.

7. Limitation of Liability

As Framepad IO is provided free of charge, our liability for defects and damages is limited to cases of intent (*Vorsatz*) and gross negligence (*grobe Fahrlässigkeit*) in accordance with statutory German regulations for complimentary software provision.

In all other instances, our liability is excluded except in cases of injury to life, body, or health, or under strict statutory liabilities such as the German Product Liability Act (*Produkthaftungsgesetz*).

8. Changes to These Terms

We may update these Terms periodically to reflect updates to the product or shifts in legal baselines. Continued use of Framepad IO after revised terms are posted constitutes your functional acceptance of the updated framework.

9. Governing Law & Jurisdiction

These Terms and any disputes arising out of or in connection with them are governed exclusively by the laws of the Federal Republic of Germany, excluding its conflict of laws principles and the UN Convention on Contracts for the International Sale of Goods (CISG). If legally permissible, the exclusive place of jurisdiction for all disputes shall be the provider's place of operations.
